The National Communications Authority (NCA) has issued a Notice of Proposed Licence Amendment to Next-Gen Infraco (NGIC), seeking to remove the 5G exclusivity clause contained in the company’s licence.
In a statement dated March 4, 2026, the Authority said the proposed amendment is being made under Section 14 of the Electronic Communications Act, 2008 (Act 775).
According to the NCA, eliminating the exclusivity provision is intended to promote greater competition and innovation in Ghana’s 5G market, improve consumer choice and service quality, and accelerate nationwide digital transformation.
The regulator added that the move would also ensure the optimal and efficient use of radio spectrum, which it described as a critical national resource.
Under Section 14 of Act 775, the proposed amendment will take effect 90 days from the date of the notice unless a different decision is reached after considering any representations submitted by the licensee within the statutory notice period.
The NCA emphasised that the process follows due legal procedure and aligns with its mandate to regulate the communications sector in the national interest.
“The proposed amendment follows due process and is consistent with the Authority’s mandate to regulate communications services in a manner that safeguards the national interest,” the statement said.
In a related update, the NCA disclosed that NGIC has so far deployed 49 5G sites nationwide. Of these, 43 are located in the Greater Accra Region, two in the Ashanti Region, and one each in the Western, Northern, Bono and Central regions.
The Authority further revealed that NGIC is currently in default of a licence fee instalment payment under the Schedule of Licence Fee Payments outlined in its licence conditions. It said the issue is being handled in accordance with applicable licence terms and relevant statutory provisions.
The NCA reaffirmed its commitment to ensuring transparent, fair and predictable regulation to foster sustainable investment, competition and growth within Ghana’s communications industry.
